POKSTATS, located at 8 square de la grande charbonnière, apartment 12bis, 35700 Rennes - RCS Rennes 980845499, acting as a data services provider as defined by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, effective since May 25, 2018, as well as by the amended Law No. 78-17 of January 6, 1978, concerning information technology, files, and freedoms (hereinafter collectively referred to as the 'Regulation'), places great importance on the protection of personal data.


This policy (hereinafter referred to as 'the Policy') applies to all websites, services, and applications (hereinafter referred to as 'the Services') offered by POKSTATS (hereinafter 'We'). Any product or service provided by POKSTATS may be supplemented by specific terms.


Through this Policy, we aim to inform users of our Services (hereinafter 'You') about the means used and purposes pursued for the collection of any information that directly or indirectly identifies a natural person (hereinafter 'Personal Data'), in accordance with the Regulation, when we act as a data processor, i.e., when we determine the purposes and means of processing.


It is understood that processing refers to any operation (or set of operations) related to Personal Data, by any method, including collection, recording, organization, storage, adaptation or modification, retrieval, consultation, use, communication by transmission, dissemination or any other form of distribution, merging or interconnection, as well as blocking, erasure, or destruction (hereinafter referred to as 'Processing').

1. WHAT KIND OF PERSONAL DATA DO WE COLLECT?

When you use our Services, you may be asked to provide personal data, either directly or indirectly. The mandatory or optional nature of the requested personal data and the possible consequences of not providing it will be specified at the time of collection.


Thus, We collect Personal Data that You provide to us, Personal Data that We obtain from third-party sources, and Personal Data that We obtain through Your use of the Services.


Accordingly, the following personal data and other information may be collected and processed:

  • Machine identifiers when using our software, connection IP address, and activity logs.

Regarding the data collected above, we may also obtain your contact details and other personal information from companies within the Group to which we belong, as well as from other third parties, including companies with which we offer joint services and that guarantee they have obtained your data lawfully; and/or from publicly available sources and/or data providers from whom we acquire data.

2. WHAT IS THE LEGAL BASIS FOR COLLECTING YOUR PERSONAL INFORMATION?

  • Sending newsletters, information, and promotional offers via email or SMS to keep you informed of the latest updates.
  • Managing applications for recruitment purposes.
  • Organizing contests.
  • Managing your rights concerning personal data protection regulations.
  • Handling potential disputes.
  • Executing and complying with all our contractual obligations.
  • Complying with legal obligations to which we are subject.

4. WHO ARE THE RECIPIENTS OF YOUR PERSONAL DATA?

Your Personal Data is processed by us, but we may also share your Personal Data (i) with appropriate departments within POKSTATS and/or (ii) with authorized external service providers. Departments within our Group and external subcontractors act according to our instructions and strictly within the scope of their tasks (e.g., to process your payment or create your invoice). In this context, your Personal Data is neither sold nor rented to third parties.


In any case, we ensure that those authorized to process your Personal Data (staff, partners, subcontractors, etc.) are committed to maintaining the confidentiality of Personal Data or are bound by an appropriate legal confidentiality obligation. Specifically, we ensure that our employees who may have access to your Personal Data as part of their duties are trained on Personal Data protection.

5. HOW ARE YOUR PERSONAL DATA SECURED?

As part of our obligation of means, we inform you that appropriate organizational and technical measures are taken to ensure the security, integrity, and confidentiality of your Personal Data and, in particular, to prevent it from being altered, damaged, or accessed by unauthorized third parties.


Furthermore, we commit to maintaining the confidentiality of Personal Data and not disclosing it in any form, except (i) as part of the execution of the Services and the purposes of processing; (ii) in compliance with a legal or regulatory provision; (iii) in response to requests from judicial and/or administrative authorities; (iv) to exercise our rights or those of our partners and third parties; (v) with your prior consent or at your request.

6. HOW LONG WILL YOUR PERSONAL DATA BE KEPT?

We retain your Personal Data for as long as necessary to fulfill the purposes for which it was collected. We also retain your Personal Data for the period defined by law, particularly in civil and commercial matters.


For example, Personal Data required for commercial prospecting, including name, surname, postal address, email address, and phone number, is retained for a period of three years after the end of the commercial relationship. If you are a prospect, your Personal Data is retained for a maximum of three years from the date of collection or the last active contact with you.


Similarly, as an example, if you are a job applicant, if your application is rejected and you do not request the destruction of your application, your Personal Data will be retained for a maximum of two years after the last contact. Only your explicit consent allows for longer retention.

7. WHAT ARE YOUR RIGHTS REGARDING YOUR PERSONAL DATA?

In accordance with the regulations, you have the following rights:

  • The right to access your Personal Data.
  • The right to rectify your Personal Data if it is inaccurate.
  • The right to delete your Personal Data in certain cases.
  • The right to restrict the processing of your Personal Data and the right to data portability, within the limits established by applicable regulations.
  • The right to withdraw your consent at any time when the processing is based on it.
  • The right to object to the processing of your Personal Data.
  • The right to determine directives regarding your Personal Data after your death. Without such instructions, your heirs may exercise their rights over your Personal Data.
